Between Nomos and the Calculator

Summary/Abstract: The article aims at tracing out the socio–historical process of the emergence of the modern form of law – the legal act as a necessary element of the birth of modernity. In its first part the analysis is attempting to give a theoretical justification of the integrative uniformity of the law understood as a meaning and social action and in that way to overthrow the still dominating Kantian division of the reality into „Sein“ and „Sollen“ i.e. the separation of the law from the sphere of social empiricity. In the second part the accent is placed on a grand historical process – the so-called „great codifications“. The analysis of a concrete historical period attempts to show how the modern society gives birth to its own normative „reflection“ - the abstract legislation which – by using a specific legal language deciphers all key social requisites of modernity.
