Specifics of the Dispositive Part and the Executive Action for Traffic Crims under Art. 342 of the Criminal Code

Summary/Abstract: CRIMINAL LAW // The present study analyses crimes under Article 342 of the Criminal code and their objective characteristics in particular. The crimes under consideration are a part of traffic crimes. These crimes result from safety-rules violations, which endanger people’s lives and health. In that regard the article discusses some issues which deal with the specifics of the crime due to the blanket character of the dispositive thereof, as well as the forms of the executive act. The conclusion makes a de lege ferenda proposal for the repeal of the objective feature “while driving” in the dispositive part of Article 342, paragraph 1 of the Criminal code.
