The Labor Code – between the flexiblity and the stiffening of labor relations

Summary/Abstract: Starting with the public debate over the project of the Law regarding the ammendment of the Labor Code there was a major discontent for employees, employers, unions and also doctrinarians and practitionars in the field of labor law. The public debates were strong, a lot of criticism was put down on paper before and after the Law nr. 40/2011 for the ammendmet and the compeltion of Law no. 53/2003 – the Labor Code was passed by the Parliament, and the practitioners are at present being confrunted with numerous problems regarding the interpretation and application of the provisions of the Labor Code, the ammended version.
