Summary/Abstract: Institution of changing the individual labor contract has not undergone substantial changes. Changes that have been made are intended to enhance the protection of employees, limiting the maximum duration that delegation, a measure taken unilaterally by the employer, may have within 12 months. As regards the individual labor contract, the institution of suspension of the individual labor contract, changes brought by Law no. 40/2011 for amending and supplementing Law no. 53/2003 – the Labour Code, are more consistent. Some of the changes are designed to address several problems in practice in interpreting and applying the provisions of the Labour Code, while other changes are tools available to employers to assist them to adapt to crises and fluctuations in workload, reducing costs without being forced to dismiss personnel.
