Aspects of novelty regarding the content of the individual labor contract following the amendment of the Labor Code brought by Law no. 40/2011

Summary/Abstract: Law no. 40/2011 regarding the amendment of Law no. 53/2003 – the Labor Code, brings a few novelty aspects regarding the content of the individual labor contract, especially the provisions that need to be included in the written document (instrumentum) of such a contract. Some of these new elements raise difficulties in practice regarding the interpretation and application of the amended legal provisions. We consider that for a correct interpretations and application of these new provisions it is necessary for these provisions to be analyzed in conjunction with the other amendments brought, thus taking into consideration the purpose of the legislator.
