Summary/Abstract: The article brings to forefront the issue of the prohibition for lawyers to hire law graduates as support staff. Thus, the question that arises is whether and how the prohibition in art. 186 of the Statute is in harmony with the art. 3 paragraph (1) of Law no. 53/2003, but also with art. 15 paragraph (1) of the Charter of Fundamental Rights of the European Union. Also, art. 41 paragraph (1) of the Constitution shouldn’t be overlooked: "(1) The right to work can not be restricted. The choice of profession, trade or occupation and the workplace is free ".
