Summary/Abstract: The article seeks to identify the possibility of lawyers from Romania to use the logo of the Bar Association where they are practicing their activities, given that there is one express legal provision, provided by the art. 122 para. 4 of the Statute of the lawyer profession which is insufficient to fully clarify the legal status of this matter considering that this legal text restricts the use of the logo only in the contracts of legal assistance. Applying the Law No. 8/1996, regarding the field of copyright, is not a solution considering the disposition of art. 9 letter c) who establishes that the symbols of the state, public authorities and organizations such as: the coat of arms, the seal, the flag, the emblem, the blazon, the badge and the medal, cannot benefit from the legal protection of copyright. The Law No. 84/1998, regarding trademarks and geographical indications, also regulates the collective trademark, as defined by art. 3 letter e), a mark serving to differentiate the products or services of the members of an association from the products or services belonging to other persons.
