The Right of Image: Issues Related to the Reproduction and Use of a Person's Picture in the Media

Summary/Abstract: Romanian Law avows every individual exclusive right over image use and exploitation. Whether dealing with image right protection distinctively or as a part of the right of privacy, all authors agree that any reproduction, publication or exploitation of portrait photography requires consent. The present study discusses various issues related to the image rights, such as: using a person’s image exclusively for the purpose of the determined consent, the prohibition of publishing pictures of a person in a public place without the permission, the problem of collages and assemblies photographic and cinematographic or the use of a picture published without consent for commercial gain.
