Summary/Abstract: Archive originated in the war has an important value and significance for everyone in Bosnia and Herzegovina. It would be expected that the same attitude is reflected in the legislation concerning archive. However, by analysing all legislation it is visible that the war originating archive is not treated the way it should be. Archives in charge, in many cases, do not have legal ground to create a special relation towards that archive, in case of both creator of archive and keeper of it.We believe that changes and amendments to the current laws dealing with archive should be suggested through the Archive Association of Bosnia and Herzegovina, in order to provide an appropriate treatment to the archive of Bosnia and Herzegovina. Changes and amendments to the archive legislation should enable expert archivists, who are working on protecting the war archives, to raise a level of war archive protection in both, the process of recording and the process of keeping archive.According to the current legislation, the war archive is treated like any other archive; therefore, it is hardly likely to expect that it would be protected, put in order, handled and made available for use in archives of Bosnia and Herzegovina.
