Contributions to the study of the legal regulations on the notion, the substantive conditions and the reasons for refusal or for nullity of the registration of the trade mark

Summary/Abstract: Further to the steps taken by the author in order to contribute to the study of the regulations in the field of legal protection of the „intellectual creation”, this study is devoted to the analysis of the definition, the substantive conditions and the reasons for refusal or for cancellation of the registration of the trade mark, especially in relation to the provisions of the Law No 84/1998 on trademarks and geographical indications and of Directive 2008/95/EC of the European Parliament and of the Council of 22 October 2008 to approximate the laws of the Member States relating to trade marks. Where it has been necessary, de lege ferenda proposals have been grounded in order to improve the regulations devoted to the discussed aspects.
