Action for annulment of fraudulent acts – new aspects

Summary/Abstract: Although practice and doctrine have thoroughly covered the action for annulment of the fraudulent acts (both in the previous regulation of Law no. 85/2006 and in the actual regulation of Law no. 85/2014), there are still aspects which either have not been analyzed, either they received an interpretation that departs from the scope of this institution. In these circumstances, the article aims to analyze a range of issues that are unprecedented in terms of the concept of fraud, suspicious period, the acts removed from the scope of the action for annulment and in terms of differences between the action for annulment regulated by art. 117 par. (2) and the one regulated by art. 117 par. (4) of the Insolvency Code.
