Summary/Abstract: In the field of labor relations, collective bargaining actually expresses a legal regime characteristic for democratic countries, as it is realized through appropriate social dialogue between the social partners on the legal content of work. By law, the elected representatives of the employees may participate in the negotiation and conclusion of collective agreements at the unit level, where there is a legally constituted union or a union exists, but has not gained representation. However, the Romanian legislator has failed to regulate their legal status, legal provisions on the organization and functioning of the elected representatives of the employees are found only in the Labour Code, which causes confusion in practice about their legitimacy before employers.
