Summary/Abstract: The article focuses on a topical subject that is highly relevant for managing labour disputes. The institution of mediation, while regulated since the year 2006, is little known and applied in Romania, although in other EU states it is a frequent, and in certain situations, even a compulsory practice. Further to the recent legislative amendments, there have been opinions in favour of introducing mandatory mediation. However, the recent legislative changes only introduced provisions on mandatory information on mediation, as well as on advantages, effects, rules and limitations of information on mediation, tailored to specific situations. The compulsory provisions of Labour Code article 38 require the identification of types of labour dispute where mediation shall be used, and lays out the scope of these provisions.
