Summary/Abstract: The contarct of mandate without representation was legislative regulated with the adoption of the civil code, and has its own juridical physiognomy. In this study we analized the general provisions which applies to the contract of mandate without representation, a later study will analize the applications of this contract (commission contract, consignment contract and expedition contract). We analized the specific effects of the mandate without representation, effects produced by third parties, the effects of the contract that occur in respect of the acquired goods by the empowered person, as well as the situation of the creditors, without insisting on the relationship between the one who empowers and the empowered person, which are governed by the rules of mandate with
