Summary/Abstract: According to Law No. 8/1996 on copyright and related rights, as amended by the enactment of Law No. 285/2004, the protection of the criminal law covers from among the moral rights recognized to authors of work only the paternity right and the right to name (Article 141). To start with, the authors carry out an overview of the first regulations on the moral rights of the author at the international level. At the same time is also presented a brief history of regulations in Romania, starting with Law No. 126/1923 on literary and artistic property, then the Decree No. 321/1956 the current law, namely the Law No. 8/19968/1996 on copyright and related rights. Concurrently, it is undertaken an analysis of the offence provided for in Article 141 of Law No. 8/1996 in relation to the provisions of the new criminal law.
