Liability insurance of the railway carrier – critical remarks

Summary/Abstract: The article discusses the issue of civil liability insurance of a railway in Poland. The author reviews legislative acts regulating the liability of railway carriers for civil liability insurance, with particular reference to the Regulation of the Minister of Development and Finance of 25 May 2017 on the insurance of a railway undertaking, in an attempt to evaluate them. The article also presents European law acts concerning the scope of civil liability insurance of entities providing transport services in the railway sector. The author also analyzes the legal nature of the carrier’s liability insurance, treating them as different conceptual compulsory insurance.
