Summary/Abstract: Both the doctrine of the international humanitarian law and the judicial practice has contradictory views on the reserves and the interpretative statements summarized briefly below. Some of them are said to be justified or necessary, others are said to be useless, while those that contradict the purpose of Protocol I to reconcile the military needs with the humanitarian law prescriptions should be withdrawn by the States that have made them.
