On the Nature of Social Law and the Right to Social Security

Summary/Abstract: It is on the grounds of a systematic analysis that the social rights of people are examined. A conclusion is drawn, according to which the knowledge of social rights that is based on the theoretical constructions of the separate branches of law form the inter-branch scientific discipline of Social Law, while the regulatory acts that concern the regulated relations in the social sphere form the system of social legislation. The system of knowledge of social security is only a portion of the knowledge of social rights. In the science of social security law, which forms part of the legal knowledge, the term “social security” is both a subject-forming and a boundary category, inasmuch as it is the most general one with respect to the level of logical generalization of legal knowledge in the field of social security.
