Summary/Abstract: The purpose of the article is to analyze changes in penal policy on the example of drug offences, in particular drug possession. An anti-drug penal policy based on severe penalties for the possession of even small amounts of drugs does not bring the expected results. The amendments to the Act on counteracting drug addiction did not solve the problem. Moreover, these regulations cause doubts about their compliance with constitutional principles. For several years, many countries around the world have been changing their criminal policy in the field of combating drug-related crime, e.g. by keeping the criminalization of drug supply and demand, but the actual decriminalization of consumer activities is applied. Twenty-one years of experience with the restrictive anti-drug criminal policy prove that it should be considered to be changed its direction in Poland towards a prophylactic and therapeutic model.
