Summary/Abstract: A collection of articles devoted to the analysis of present solutions and proposed future models of the functioning of official food control in Poland in the context of administrative, financial, agricultural, and food laws. The authors discuss the following issues: the system of official food control in light of European Union legal requirements, supervising food safety and the mutual relations between different inspection authorities responsible for this supervision in Poland, public management in the area of official food control.

- Summary/Abstract:The role of food in human life and continuous technological progressrequire the creation of an appropriate legal framework guaranteeing protectionof consumer life and health. One of the most important elementsof food safety is the official control system which binds EU law requirementsand institutional autonomy of member countries ensuring theircooperation. A properly functioning system should be characterized bycompetency, efficiency and clarity, and undertaken actions should takeinto account the proportionality and precautionary principle. This purposeis served by numerous rules of a mandatory nature, multiannualcontrol plans, RASFF system and guard institution – EFSA. Thanks to itsdiversity, it is possible to take into account the specificity of individualsectors of food law and ensure comprehensive protection of health andlife of the consumer from farm to fork. At the same time, the traceabilityof products is required to ensure functionality of the system and its flexibilitywith regard to constantly emerging threats.

- Summary/Abstract:One of the considered strategies for the reform of the system of foodsafety controls is the consolidation of administrative bodies operating inthis area. This idea reflects the trends that are visible in Europe not onlyin relation to the organization of institutions dealing with food security.Similar transformations are also taking place in other sectors in order toensure better coordination and increase the efficiency of public administration.This trend is triggered by critical reflection on the effects ofradical agencification, which increased the accountability of institutions,but created challenges in terms of coordination and cooperation. Thisarticle analyses the experiences and patterns in improving coordinationand cooperation in the activities of government agencies and formulatesimportant conclusions for discussion on the future of organs of foodsafety controls in Poland.

- Summary/Abstract:Official food control is a crucial part of a food safety system. Accordingto European Union law, the structure of the official food controlauthority is regulated on the member state level, but union level law hasdirect influence on organization of the official food control authorities.Domestic regulation has to guarantee broad enforcement of aims, rulesand competences of official food control. Because of that, it is impossibleto discuss the reform of the official food control authorities’ structurewithout taking into account new EU regulation on official food control.The subject of this article is a general outline of the new Regulation2017/625 on official control, however the attention is given to the rulesof delegating certain official control tasks by the official food controlauthorities. These rules are analysed in the light of doctrinal conceptionof privatization of administration.The author concludes that new EU regulation on official food controlallows the member states to improve delegation of some tasks of theofficial food control authorities, and as a result to guarantee not lowerlevel of protection of human life and health as well as protection of consumerinterests, but with less burden for food business operators.

- Summary/Abstract:The article is devoted to the presentation of the legislative workon the draft Law on Food Inspection, prepared by a team of expertsfor Parliamentary Club Kukiz’15. Such issues are presented as, amongothers, current normative regulations in the field of official food controlin Poland and their criticism, intentions of project promoters, generalassumptions and key solutions of the commented project, as well aspractical obstacles to its adoption, which decided about its fate, that is,it remained only a legislative project, without significant opportunitiesto be enacted and enter into force.According to the authors, a thorough and comprehensive reform ofofficial food control in Poland faces resistance, and the fact of havinga parliamentary majority and the involvement and the ability of legislatorsis not enough to overcome it. The reasons are: “clerks pressure”(resistance of unions of inspection employees and management of inspections),lack of real political will of the ruling politicians and socialconcerns about food quality and safety.

- Summary/Abstract:The complex free-trade agreement CETA (Comprehensive Economicand Trade Agreement) is aimed to simplify trade relations between theEU and Canada. CETA preserves European standards which as a rulewere not subject to negotiations. This concerns food security, labourrights and environmental protection.In relation to food law and official control of foodstuffs, DeclarationNo. 7 concerning the protection of the precautionary principle in CETAis important. Moreover, it is worth stressing that no CETA provisionscontravene EU norms (including those on food safety, environmentalprotection or consumers), and therefore in order to export Canadiangoods to the EU, they must comply with all EU standards and regulations. The official control authorities in Poland have precisely describedcompetences regarding commercial exchange with third countries, Canadaincluded, mainly on border controls. Border controls comprise atleast systematic monitoring of documentation, random identificationchecks as well as, where applicable, direct checks, including procurementof samples for laboratory examinations.The provisions of CETA, having correspondence to competences ofthe official food control bodies, set down new tasks for these bodies, notonly on a national and European level, but also in relations with a countryon another continent – thus global.

- Summary/Abstract:The article presents a model of the organs of the Russian systemof official food control. The model deeply differs from Polish solutionsand official EU food control models, therefore its analysis in the institutionalaspect may be useful for the ongoing discussion on a reformin Poland. The article indicates a number of entities included in the officialfood control system of the Russian Federation. Although in this countrysuch a general concept is unknown, its use is justified as there exists anextensive system of food safety and quality control organs, whose functionsare similar to the EU solutions. The main entities that belong tothis system are presented in legal and organizational aspects, functionsperformed and their fundamental competences.A particular emphasis was placed on two basic organs, i.e. the FederalService for Veterinary and Phytosanitary Surveillance (which correspondsto the Polish IW and PRIORIN), as well as the Federal Servicefor Supervision of Consumer Rights Protection and Human Well-Being(corresponding to the following inspections: IH, IHJARS and PIS).

- Summary/Abstract:The existence of a legal norm in the administrative law system constitutingthe basis of action (and most often in a ruling manner) ina given administrative case and determining the competence of a publicadministration body to apply such norm is the basis for the implementationof the principle of the rule of law. Inflation of food law rules,however, makes the above an extremely difficult task, primarily due tothe ambiguity and exclusion of legal norms. The aim of the article is topoint to the competence problem in the field of food safety supervision,appearing in particular between the Veterinary Inspection and the StateSanitary Inspection during supervision over the production of compositefood and the processing of animal origin food in the context of retailtrade. The article has been divided into preliminary remarks concerningthe conflict-of-law rules and detailed ones concerning the problem of thesituation indicated above. An important part of the considerations is theintroduction of areas in which legislative action is necessary (supervisionover the production of composite food consisting simultaneously of vegetableorigin food and unprocessed food of animal origin).

- Summary/Abstract:The problem of the decision creating a binding obligation resting onthe inspected entrepreneur to pay laboratory fees (based on Article 30of the Trade Inspection Act) has not been a subject of a broader discussionin the literature. However, considering practice of its application, itneeds to be examined closer. In particular, a legal form of this obligationshould be analysed in the context of regulations related to fees laid downin Polish Code of Administrative Procedure and other regulations relatedto product safety and market surveillance (also controlled by TradeInspection in Poland). The important question is also the ratio of thisobligation to administrative sanctions regulated in Article 40a, section1, points 3, 4 and section 3 of Polish Act concerning trade quality ofagri-food products – for commercial introduction of products that do nothave this quality (including adulterated products).

- Summary/Abstract:The article presents the results of analysis of administrative risk assessmentin the European Union and Poland. The author’s goal was toidentify the institutional impact of scientific work on the safety andquality of the products in the EU food chain. The publication was createdby using the dogmatic method, which was complemented by comparativelaw analysis. In the first part of the article, the author discusses thestructure of risk analysis in the food chain. The text presents analysis ofthe activities of the Food Safety Authority in the context of direct andindirect impact on safety and consumer interests. In the further part ofthe article, the author characterizes institutional risk assessment in thefood chain in Poland. The publication also includes references to publicadministration organizations in other EU member states. The final conclusionscontain de lege ferenda postulates and show the essence of theinstitutional risk assessment for safety and quality in the food chain.
