In this paper, the author focuses on the legal regulation of animal transport as a special domain in the legal protection of animal welfare. With reference to the European Convention for the Protection of Animals During International Transport, the Animal Welfare Act of the Republic of Serbia and the accompanying statutory acts on this issue, as well as the Council Regulations (EC) No. 1255/97 and No. 1/ 2005, the author casts more light on the normative framework governing the commer cial transport of animals, without embarking on the analysis of the veterinary and sanitary requirements and respective veterinary and sanitary control of animal transport. The author points to the principal drawbacks in the process of drafting the national statutory acts on animal transport, discusses the degree of (in)compliance of the national regulations on animal transport withthe European legislation on this matter and emphasizes the need to take a wide range of legal measures in order to provide for a more substantial protection of animal welfare during transport

One of the most complex issues considered within the International Law Commission during the codification of rules on state responsibility was the issue of making a distinction between international crimes and international delicts as two categories of internationally wrongful acts. The well-known Article 19 of the Draft Articles on State Responsibility adopted at first reading introduced not only this differentiation but also examples of international obligations whose breach may be qualified as an international crime. Massive environmental pollution or, specifically, a serious breach of an obligation essential for environmental protection, appeared, somewhat unexpectedly, among the examples. This article analyzes the provision contained in Article 19 not only generally, but also interms of the rules of international environmental law. The focus of the analysis is on the reasons that guided the Commission when drafting Article 19, on the legal consequences of qualifying certain act as a crime or a delict, as well as on the arguments that prevailed when deciding not to include Article 19 in the present Rules on State Responsibility adopted by the International Law Commission at second reading in 2001. In that regard, the author examines the consistency of the Commission’s decision with certain rules that still form an integral part of the Rules, but also the perspectives of qualifying massive environmental pollution as an international crime.

The author elaborates the concept of the state of necessity as one of the basis for elimination in the case of violation of law. T aking into account the fact that the criminal offence is the matter of criminal law, as an individual law field it determines the elements of criminal offence whose comulative action leads to criminal offence and only as such it can exist. However, if one of the elements of criminal offense is not fulfilled, it cannot be determined as one. In the criminal laws, in relation to the subject matter, there are determined basis which exclude the unlawfulness of criminal offence as one its basic elements. I nter alia, the main reasons for elimination of unlawfulness are: minor insecurity or minor offence, self-defense and state of necessity. The author elaborates the concept of the state of necessity as the basis for elimination of unlawfulness, whereas he takes into consideration its characteristics as well as the issues of violating the boundaries determined by the state of necessity, lead to cancelation and identify criminal offence.

Since the 1980s, the international community has paid a great deal of attention to Iraq because its conduct has repeatedly threatened or breached international peace and security. International reaction has varied from condemnation (during the Iran-Iraq War in 1980s) to military action (when liberating Kuwait in 1991). A controversial phase began in 2002, when the United States and the United Kingdom argued that the international community should react more decisively and forcefully to address Iraq’s unwillingness to meet the obligations that had been imposed on it by the Security Council. First, they hoped that the Security Council would authorise the use of armed force, but this was seen as excessive by many countries, and authorisation was blocked. Then, together with Australia, they chose to act unilaterally and launched a military intervention on the 20th of March 2003. The allies invoked several justifications for their action (humanitarian intervention, an operation against terrorism, self-defence), but the principal basis was an implied authorisation from the Security Council. They posited the argument that when the Security Council’s Resolutions 678, 687 and 1441 were interpreted together, then Iraq’s continuing defi ance in 2003 revived the explicit authorisation that had been given in 1990. This argument is dubious for several reasons. Why should authorisation be revived 12 years later and in a different context? The original authorisation was given for the use of armed force in co-operation with the Kuwaiti Government to liberate Kuwait and consequently to restore peace and security to the region. Operation Iraqi Freedom, however, was conducted without the involvement of Kuwaiti Government and was initiated with the sole intent of restoring (supposedly threatened or breached) peace and security to the region. The aforementioned resolutions envisioned a decisive role for the Security Council (e.g. whether Iraq continues to defy its international obligations and how to subsequently react), but the allies took the liberty of making decisions unilaterally. The revival arguments rely on the presumption that authorisation was only suspended when the ceasefire was agreed to between Iraq and the coalition in April 1991. However, deliberations of the Security Council indicate that the countries had accepted that the cease-fi re ended the authorisation, and individual action by a coalition member was no longer a possibility. In conclusion, Operation Iraqi Freedom lacked a clear legal basis.

Iraq has been struggling with the issue of human rights protection since its independence in 1932, and its complicated history, ethnic and religious tensions have made building a sustainable human rights protection system problematic. There was a hope for progress in terms of human rights in the year 2003, when democracy was re-established and Saddam Hussein was removed from power, but more than ten years later, the situation is just as problematic, and only the violations are different. To some extent, the roots of human rights protection problems lie in the traditional Iraqi perception of society, where human rights are continually breached on ethnic, religious, sexual and political grounds. Many violations happen because of a lack of knowledge of human rights and the lack of access to education. The government of Iraq has not been able to ensure effective control over their territory, and no real desire to deal with the protection of human rights can be observed. The last elections in Iraq were declared free and fair, but democracy and especially the rule of law in Iraq leaves much to be desired. There are continuous problems with low administrative capacity, violence and corruption, and an inability, and, in some cases, a reluctance of the government to protect human rights. As a result the government does not safeguard even most basic human rights. It is increasingly evident that a democratic government alone is not enough to ensure human rights in a situation where human rights are violated by almost all of the political, ethnical and religious groups sharing the power in Iraq. As a result the prospects of positive developments in the area of human rights in Iraq in the coming years are extremely small. When we assess the future possibilities for ensuring human rights, we need to keep in mind that in the year 2013, Iraq continues to be a country, where the human rights situation is one of the worst in the world. The withdrawal of foreign military forces has rather changed the human rights situation in Iraq for the worse, because there are now fewer institutions that can ensure human rights, and the administrative incapacity has increased. International partners (including Estonia), need to take a critical look in the mirror and continue to take steps toward greater responsibility and positive action in terms of human rights awareness and protection in Iraq. Writing negative reports can raise awareness of the problems in Iraq, but in bringing knowledge, expertise and fi nancial assistance is that what can improve the situation in practice.

Legal Dialogue of the Obligation Relation Parties with the Participation of a Spouse-After the Polish Law of Matrimonial Property Amendments Under the Law of June 17th 2004 The matrimonial property law, which regulates not only the property relations between spouses themselves but also between one of the spouse and his/her personal creditor, has particular significance in free market economy in which the spouses are the subject of numerous civil law (obligatory) relations as not “consumers” but as “entrepreneurs”. The last amendments of the law from June 17th 2004 introduced new legal institutions to the Polish system which have for their object, due to the governmental justification on the project of changes in family and prevention codification, combining two goods: the spouse’s (spouses’) creditors interest and spouse – debtor family interest remaining in the system of the common property. Above all, the author submitted to more profound reflection the new legal institutions introduced by the regulation of June: facultative and obligatory spouse’s agreement (art. 37 § 1 and 41 § 1 family prevention codification), the spouse’s objection to the spouse’s intentional activity to manage the common property (art. 36[1] fpc) as well as the common property management itself which, in relation to the hitherto existing regulation, is treated more liberally as, at the present time, each of the spouse can manage the common property himself and practically without any limits (art. 36 § 2 fpc). One can claim that, on the one hand, the legislator protects the creditor’s just interest by enabling him future execution from the common spouses property, conditioning the possibility on the creditor’s providence which is – gaining the spouse – debtor’s agreement to contract obligation which absence do not cause legal activity invalidity (art. 41 § 1 fpc). On the other hand, the family interest is fairly protected by profound enumeration of legal activities undertaken by one of the spouses to the validity of which the agreement of the other spouse in necessary (art. 37 § 1 fpc). The reflection is not only focused on the spouses’ substantive law situation, their responsibility for the obligations but they also relate to the creditor’s legal situation, who can demand satisfaction for his claim on the judicial proceedings. It seems that balancing interests of the two parties of the obligatory relation and their property protection has achieved only the partial objective. However, this appraisal would only be verified properly by still not existing interpretation of the regulations carried out by courts and legal doctrine.

The refusal to deal with certain suppliers or beneficiaries – a type of dominant position abuse in the activity of undertakings. The abuse of dominant position is an anticompetitive practice prohibited by the competition law which may be achieved in several ways. One of these, expressly and legislatively regulated by the Romanian competition law, is represented by the “refusal to deal with certain suppliers or beneficiaries”. However, the Romanian legislation does not define the concepts, infrequent in common law, used in the imposed interdiction nor does it specify the limits of “the refusal”. The notes defining the concepts can be however learned analyzing the decisions of the Court of Justice of the European Union. Hence it is necessary to determine the scope of the concepts and to identify the actual forms of expression of “the refusal to deal with certain suppliers or beneficiaries” in order to conclude whether or not there exist a prohibited abuse of dominant position.

It argues that Cicero strongly influenced the manner in which the classical Roman jurists argued and reasoned. This proposition is supported by the works of Seneca (elder) and Quintilian whose works reflect legal argumentation during an important period of Roman legal development.

La faute – commutateur de la charge des risques. Le contrat peut être défini comme un pari sur l'avenir, parce que personne ne peut savoir ce que le futur implique. Alors, que doit-on faire quand l’exécution d'un contrat est empêchée par un événement qui n'a pas été envisagé lors de la conclusion du contrat ? Et, plus difficile, qui supporte les risques dans l'hypothèse où le cas fortuit est précédé d'une faute contractuelle du créancier ou même du débiteur ? Pour répondre à ces questions, nous avons structuré notre étude en trois parties. Alors, au début nous avons parlé (1) de la question du transfert des risques de l'obligation corrélative du débiteur au créditeur en faisant puis (2) une distinction entre les risques de l'obligation devenue impossible et ceux de l'obligation corrélative, tout en finalisant (3) avec la présentation de quelques exemples pratiques.

State responsibility for the conduct of state organs in international law. The purpose of this paper is to describe briefly the issue of state responsibility in international law, with a special analysis of the situation of state responsibility for the conduct of state organs. This writing is an introduction to the study of international responsibility of states. In this work I tried to describe the shape of the subject in a general manner. I discussed also the problems of attribution of conduct of states organs to the state. I have tried to correlate the work of International Law Commission on state responsibility with the issue of authority. I exposed a critique of an author on the conception of state responsibility adopted by the ILC. The classic hypothesis in which the state responsibility is engaged it is for the conduct of it`s organs. I explained the meaning of the term organ in accordance with the view of ILC. In the end I attempted to make a connection of the ILC drafts on state responsibility for internationally wrongful acts and the three types of law described by Georg Schwarzenberger. Ideal types of law that could enable us to understand better a legal system.

On the nullity of contract and the notion of unwritten clause under the new Romanian civil code. The new Civil Code contains a more detailed regulation of the legal regime of the invalidity of the contract. Alongside with the classical partial invalidity of the contract, the new Civil Code refers in many instances to clauses deemed unwritten. The lack of a precise regulation of the regime of these clauses opens the possibility for several qualifications, from a simple form of invalidity to a distinctive institution. The present paper has the purpose to offer, based on the analysis of the legal texts and settled juridical situations, functional solutions to the legal regime of the clauses deemed unwritten as well as to certain particular aspects of the legal regime of the invalidity.

Des considerations concernant le divorce amiable par voie notariale. Le divorce représente l’une des principales institutions du droit de la famille. L’acceptation du nouveau Code Civile a apporté un element de nouveauté en matière de divorce, cela veut dire le divorce de commun accord réalisé par le notaire public. L’inspiration de l’homme de loi provient de la nécessité de l’adaptation de la loi à l’évolution sociale et de la famille, mais aussi de l’entente par voie amiable de la crise du marriage. L’article en cause se propose d’analyser les principales conditions d’accès, aussi que la procedure du divorce notarial vues les situations qui impliquent des enfants. Les marques du divorce notarial qui impliquent des enfants seront analysés en faveur de l’intérêt supérieur de l’enfant, celui-ci étant un élément primordial.

Considérations sur l’établissement de l’habitation de l’enfant. À la fois avant et après l'entrée en vigueur du nouveau Code civil, l’habitation de l'enfant, né dans le mariage ou hors mariage, était et est, en principe, à ses parents. Aucune distinction fondée sur le statut matrimonial ne sera faite. En dépit de tout ce fonds commun, le code ne manque pas d'innovations dans l'établissement de l’habitation de l'enfant, comme une des prérogatives de l’autorité parentale exercée, selon les règles récentes, de manière partagée par les deux parents, mariés, célibataires ou divorcées. Les notions « exercice de l'autorité parentale » et «établissement de l’habitation de l‘enfant" sont interdépendantes et non superposables. De cette perspective, nous souhaitons examiner les paramètres normatifs l’habitation de l’enfant est établie. Après un regard comparatif brève sur les dispositions concernant l'établissement de l’habitation de l’enfant contenues jusqu'à récemment dans le Code de la famille et la nouvelle vision du législateur exprimée dans le Code civil (I), nous présentons les implications du principe de l’exercice en commun de l’autorité parentale sur l’établissement de l’habitation de l’enfant (II), en mettant l'accent sur la situation des parents divorcés ou non mariés (III), la possibilité d'établir un autre logement alternante pour l'enfant (IV) et, enfin, les conséquences de la "coparentalité" sur le changement de l’habitation du parent avec lequel habite l'enfant (V). Contrairement à la mesure d’octroi de l’enfant en vue d’éducation et de formation en cas de divorce – et, par analogie, en cas d'établissement de la filiation hors mariage – présente dans la réglementation antérieure, la règle de l’exercice en commun de l’autorité parentale ne résout pas le problème de l’habitation de l’enfant. Le fait que maintenant les parents divorcés continueront d'exercer conjointement l'autorité parentale, signifie en ce qui nous intéresse ici le fait qu’ils décideront de commun accord sur l’habitation de l’enfant dans l’avenir. Mais la règle invoquée ne désigne de soi-même en concret le parent ou le tiers avec lequel l'enfant vivra. À notre avis, sous l’ancienne réglementation, le «duel» entre les parents en train de divorce ou divorcés ayant comme mise l’octroi de l’enfant s’est déplacée sur le terrain de la désignation de ce parent auquel se localisera l’habitation de l’enfant. C’est implicitement le terrain du parent « continu », qui sera présent, effectivement et affectivement dans la vie quotidienne de l'enfant et qui, par la force des circonstances, disposera de ressources supplémentaires d’influence sur ceci. C'est précisément à cet égard, de l'établissement de l’habitation de l'enfant dans un climat de «crise» qui a repris les relations entre les parents se glissa certaines incohérences ou inconséquences des prescriptions légales.

Eternisation de la volonté du de cuius par substitution fidéicommisaire. Les substitutions fidéicommissaires trouvont leur origine dans le droit romain où elles étaient une modalité d’organiser la transmission du patrimoine du disposant selon sa volonté. C’était le pater familias qui avait le pouvoir de décider ce qui va se passer avec ses biens après sa mort en choisissant la manière dont ils seront utilisés et aussi leur destination. Ces substitutions fidéicommissaires ont été largement répandues en Europe durant l’époque féodale ayant comme principal objectif la conservation des biens au sein de la même famille. Pourtant, le législateur du Code Civil roumain de 1846 a pris une position complètement opposée en les interdisant. Si le droit romain donne une grande importance à la volonté individuelle, une fois le Code Civil de 1846 adopté, la balance s’incline vers la protection de l’intérêt général. Mais, le nouveau Code Civil a essayé la conciliation de ces deux approches contraires en garantissant ainsi un équilibre entre le besoin de respecter la volonté du de cuius et la protection de l’intérêt général. C’est ainsi que le nouveau Code Civil maintient le principe de la prohibition des substitutions fidéicommissaires, mais il valide la substitution fidéicommissaire simple, unique et limitée dans le temps. C’est-à-dire, celle-ci par laquelle le disposant dénomme un seul substitué (gratifié) sans avoir la possibilité de lui imposer l’obligation d’administrer et de transmettre les biens reçus, lors de son décès, à un second substitué (gratifié) désigné par le disposant. Les nouvelles dispositions du Code font prévaloir la volonté du de cuius aux normes juridiques. Elles donnent ainsi une liberté plus grande à celui qui testera sans “éterniser” toutefois la volonté du de cuius. En effet, il n'y a que les substitutions fidéicommissaires simples qui sont permises pendant que celles graduelles et perpétuelles sont prohibées.

La conjugalité au Québec s’orchestre autour de trois modèles dont deux sont prédominants : le mariage (63%) et l’union de fait (36%). Ces unions peuvent être hétérosexuelles ou homosexuelles. Le législateur québécois s’est abstenu d’édicter des règles pour encadrer l’union de fait par respect du libre choix des couples d’adopter un mode de conjugalité qui les soustrait aux règles applicables en matière de mariage. Certains ont prétendu que cette orientation législative brimaient les personnes vivant en union de fait et leur conféraient un statut inférieur. La Cour suprême du Canada vient de valider la constitutionnalité des règles du Code civil qui encadrent les aspects patrimoniaux (effets du mariage, régimes matrimoniaux, obligation alimentaire et vocation successorale) des couples mariées et qui ne s’appliquent pas aux conjoints de fait. C’est donc plus du tiers des couples québécois qui évoluent toujours dans un espace de non-droit. Le législateur devrait-il intervenir eu égard aux droits matrimoniaux et aux droits successoraux? Quelque soit la réponse, il importe de se questionner sur l’adéquation de l’encadrement juridique dans lequel évolue les conjoints et son impact sur le droit patrimonial de la famille. Les droits matrimoniaux des conjoints ne peuvent être occultés dans un contexte successoral. Contrairement, à plusieurs législations d’origine latine, certains droits matrimoniaux ont un caractère impératif auquel on ne peut déroger alors que les droits successoraux sont des règles supplétives. Le droit québécois ne connaît pas la réserve héréditaire et promeut la liberté de tester. Le sort du conjoint survivant est donc directement lié à l’existence de droits matrimoniaux qui peuvent lui conférer un statut de créancier face à la succession et à l’exercice de cette liberté testamentaire qui lui accorde ou retire le statut d’héritier.

Jusqu’à récemment, les héritiers, les successibles c’est-à-dire, constituaient une présence discrète dans les règlementations concernant les relations de famille. Le mariage et la filiation, les sujets de premier ordre du droit de la famille, supposent un contexte inter vivos et, forcément, ils ont une signification complètement diffèrent vues de l’angle de „la famille successorale”. Ainsi les héritiers, des acteurs dans des rôles secondaires, dépourvus de sensationnel et avec des accessoires juridiques minimales, devaient mener à bien – dans le meilleur des cas – ce qui avait commencé et le héros principal n’a pas eu le temps de finir : l’action en justice ayant comme objet la filiation. Le dogme du caractère strictement personnel de la manifestation de volonté ou, le cas échéant, du droit d’agir dans l’écrasante majorité des situations concernant le sphère d’intérêt du droit de la famille – une autre manière d’affirmer du fait que l’initiative de faire usage d’une certaine prérogative implique des évaluations complexes, délicates et, pourquoi pas, d’assumer évidement la responsabilité du geste – rendait hermétique le cercle familiale tel qu’il était configuré à la date de l’ouverture de la succession. Le nouveau Code civil n’a pas apporté des changements sur l’algorithme de la succession légale : la vocation successorale générale est reconnue au conjoint survivant et aux parents du défunt, les principes de la dévolution légale de la succession – les règles de la priorité des ordres, de la proximité du degré de parenté et du partage par tête – ont été maintenus tel qu’ils ont trouvé la consécration dans les réglementations antérieurs. Cependant, malgré son inertie apparente, le droit successoral est plus „vif ” qu’avant grâce aux (et, parfois, à cause des) possibilités offertes aux héritiers par la médiation des normes de droit de la famille, de repenser le statut marital ou généalogique du défunt. Nous nous sommes proposé d’apporter à votre connaissance deux hypothèses, démonstratives, „de l’évolutionnisme” juridique: le droit des héritiers de poursuivre l’action de divorce („En divorce avec le conjoint survivant”) et le droit à l’action des héritiers en matière de filiation („en devenant parent post mortem”).

L’établissement de la filiation, la clé qui ouvre à l’enfant la voie vers un ensemble de droits importants, suscite aujourd’hui un intérêt croissant en plan international. L’évolution des structures familiales en société et le progrès des sciences médicales ont déterminé, dans le temps, reformes sensibles des législations internes en matière familiale. Leur application aux rapports de droit affectés d’éléments d’extranéité est conditionnée par la mise en œuvre des règles de conflit de lois, dont l’adaptation aux nouvelles réalités n’est pourtant pas évidente. Dans le cadre de cette étude, nous nous proposons de passer en revue les principales difficultés soulevées par les normes roumaines de droit international privé en la matière, analysant en quelle mesure ces dernières tiennent compte de différents intérêts en présence et comment répondent-elles aux évolutions imposées par le progrès technique et scientifique.
