The articles of the article analyze the forensic nature of deliberate injury to a person serving a sentence in the form of imprisonment. Several elements of forensic characteristics are investigated, which are of practical importance, since they allow us to justify versions of individuals who are interested in harming the victim's health, as well as to use knowledge and possibilities of forensic medical examination in the process of investigating deliberate damage to health of the person who carries out punishment in the form of imprisonment. Proposed by the author, use informative and cognitive orientation which will allow in practice to carry out retrospective and perspective modeling of criminal activity under investigation, to predict its development and, accordingly, to plan the course of further investigation.

The article examines the legal approaches to the procedures and grounds for consideration of the circumstances, mitigating punishment according to Criminal Code of Ukraine and Poland. The analysis revealed the pros and cons of the respective approaches and gave the basis to suggest ways of mutual harmonization of legislation of these states. The study gave reason to conclude that each of the codes has its advantages and disadvantages relative to another code and to identify common problematic aspects of each.

DOWÓD Z OPINII BIEGŁYCH W AFEROWYCH SPRAWACH GOSPODARCZYCH W ŚWIETLE DOŚWIADCZEŃ POLSKIEJ PROCEDURY KARNEJ

Przyjmując zaproszenie na konferencję dotyczącą problemów reformy systemu prawnego Republiki Ukrainy, stanąłem przed trudnym zadaniem wyboru zagadnienia, którym chciałbym się z Państwem podzielić. Z jednej strony miałem na uwadze potrzebę szukania porozumienia prawnego pomiędzy Europą Wschodnią, a zachodnim civil law i common law, oraz wynikającą stąd konieczność kształcenia i doskonalenia wiedzy prawników ponad granicami własnych krajów. Z drugiej strony zależało mi aby swoje wystąpienie oprzeć na uniwersalnych elementach dobra, słuszności i sprawiedliwości w prawie. Ciągle mam bowiem w pamięci słowa prof. dr hab. Marka Kuryłowicza – Kierownika Katedry Prawa Rzymskiego UMCS w Lublinie, który na polsko-ukraińskim forum prawniczym “IUS ET AMICITIA” w Baranowie Sandomierskim w październiku 2006 roku pięknie podkreślił, że pielęgnowanie tych ponadczasowych wartości stawia nas-prawników w zaszczytnej roli kapłanów sprawiedliwości.

ODROCZENIE I PRZERWA A SPOCZYWANIE PRZEDAWNIENIA WYKONANIA KARY POZBAWIENIA WOLNOŚCI

An enforcement of imprisonment in the same or other case suspends the running of the limitation period. Due to the Executive Penal Code is possible, to respite the enforcement of penalty or give a convict an interruption in her serving. In the period of deferment or interruption the sentence is not enforced. Ergo, during deferment or interruption of enforcement of imprisonment the term of the limitation is running. The author judges the present regulation. As a conclusion she proposes an amendment to the Code and makes a demand de lege ferenda.

ZARZĄDZENIE WYKONANIA ZAWIESZONEJ KARY POZBAWIENIA WOLNOŚCI NA PODSTAWIE ART. 75 § 1A KK

This treatise has been devoted to the normative provision introduced into the Penal Code on 1st August, 2010, which is to be found in Article 75 of the Penal Code, to which § 1a was added, ipso facto introducing the second obligatory basis for the order of the punishment of imprisonment, besides the one thus-far determined in § 1 of the above-mentioned Article. Introducing the provision in Article 75 § 1a of the Penal Code, the legislator wished to obligate the court of law to order the enforcement of the punishment of imprisonment in the case of individuals convicted for a crime with the use of violence or an illegal threat and sentenced to the punishment of imprisonment with the conditional suspension of the enforcement of it, who, during the period of probation, will perpetrate the acts of violence or use a threat one more time in relation to their next-of-kin or another juvenile individual. The purpose of this provision is that the protection of the victims of violence in the family of a convict be intensified, making it possible to order the enforcement yet prior to issuing an order of the enforcement of punishment in connection with a new crime committed in the course of the period of probation. What has been pointed out in the treatise, is the circle of individuals in relation to which violence or a threat are to be perpetrated, so as to make it possible to apply Article 75 § 1a of the Penal Code in practice, and that means the next-of-kin or another juvenile individual sharing their place of residence with the perpetrator. The authoress discusses the problem of it being impossible to apply the above-mentioned provision in relation to the perpetrators of crimes who, for whatever reasons, do not share their place of residence with their next-of-kin, and perpetrate behaviours determined in Article 75 § 1a of the Penal Code.

STOSOWANIE TYMCZASOWEGO ARESZTOWANIA W POLSCE NA TLE PORÓWNAWCZYM

Artykuł prezentuje dane dotyczące stosowania tymczasowego aresztowania w Polsce w latach 1990–2008 na tle porównawczym. Jeszcze kilka lat temu stosowanie tymczasowego aresztowania w Polsce mogło budzić zastrzeżenia co do długości jego trwania i udziału osób tymczasowo aresztowanych w populacji uwięzionych. Obecnie, Polska należy do tych krajów w Europie, które stosują tymczasowe aresztowanie dość rzadko, co zwłaszcza w przypadku osób oskarżonych o poważne przestępstwa może budzić wątpliwości.
