A BRIEF ANALYSIS OF THE OFFENCE OF THEFT OF PRODUCTS OF THE NATIONAL FOREST AND FOREST VEGETATION OUTSIDE IT

Summary/Abstract: The subject of the theft of trees from forests is a rather delicate one. Although the offense of theft of products of the national forest fund and forest vegetation outside of it, provided for in the Forestry Code (article 109), is a species variant of the offense of theft under common law (provided for by articles 228 and 229 of the Criminal Code), the legislator choose to keep it as a separate offense, given the particularities of this act. We analyzed these particularities and formulated some proposals for improving the content of the text of the incrimination norm.
