The management of another’s business

Summary/Abstract: Romanian New Civil Code regulates expressly three unlawful legal facts. In legal timeline we have business administration, undue payment and unjust enrichment. In broad lines, the new regulation doesn’t change the business administration countenance, as it is known, as a traditional institution of Romanian law. Novelty items – debatable – appear regarding some of the conditions required for administration. Art. 1330-1440 include management of other person interests: manager 's initiative in action; intention to work for other; opportunity management; impossibility, for the administrator, to carry out of own affairs; duties of business’ management and administrator’s duties. Also, ratification business’s administration. One of the unsolved in law text question consist in administrator’s allowance. Absolutely, the expenses arisen from opportune administration will be returned, but these expenditure represents amounts which made possible the administration or spreading of administrator affairs.
