Summary/Abstract: Just like the conclusion of a marriage, the continuation and dissolution thereof are an issue regarding only the spouses, even though the ones suffering from the marriage dissolution are, first of all, their minor children. For settling the crises within a marriage, the dissolution of marriage is the most drastic measure, which can have effects on the former spouses during their entire lives. One of the simplest, least expensive and most advantageous procedure for both spouses for the dissolution of marriage is by mutual agreement of the parties by administrative means. If the spouses agree with the divorce and have no minor children, born within that marriage, outside that marriage or adopted, the state registrar from the place of marriage or of the last joint home of the spouses may establish the dissolution of marriage by spouses’ agreement, issuing them a divorce certificate, according to the laws in force. Therefore, as will also be shown in the present study, the jurisdiction to settle the divorce by administrative means belongs to the state registrar from the place of the conclusion of the marriage or the last joint home of the spouses.
