The Best of the Worst and the Always Bad
Contributor(s): Maria Niełaczna (Editor), Joanna Klimczak (Editor)
Subject(s): Law, Constitution, Jurisprudence, Criminal Law
Published by: Wydawnictwa Uniwersytetu Warszawskiego
Keywords: life imprisonment sentence; prison; prisoners; prison service; diagnosis; personality disorder; rehabilitation; the right to hope
Summary/Abstract: The publication presents the latest, unique and complex results of the research on the group of 290 life-term prisoners. It summarises the five-year study on life imprisonment sentence and explores the problem from the legal, criminological and psychological perspective, giving voice to leading experts and practitioners: lawyers, psychologists, prison officers and finally the sentenced themselves. The main aim of the monograph was to answer the question what a typical life-term prisoner is (a statistical image of a sentenced) and if in the group of the 290 studied there are those best and worst and what determines it. With reference to appropriate theories, such as deprivation, import, rational choice, the authors of the texts collected here describe how the sentenced adapt to the conditions of lifetime isolation and how the prison systems adapts to them, how both sides respond to passing and executing life imprisonment sentence and how they view the diagnosis and the possibility of interacting with the sentenced in prison. It is a true compendium of criminological and psychological knowledge of the perpetrator–sentenced–human.

- Summary/Abstract:Life imprisonment sentence has caused controversies since the beginning of the rene-wed Polish statehood. In criminal law from Moderne Schule perspective this extreme punishment was imposed on dangerous criminals (habitual criminal, gefährliche Gewohnheitsverbrecher) who had to be permanently isolated from the society. In the beginning, life imprisonment in the dual-track system was administered along with post-penal safeguard measures. The author attempts to synthesise the evolution of life imprisonment sentence and presents concerns about it. He implies that the return to wide use of post-penal detention is an especially worrying trend in modern law.

- Summary/Abstract:The article discusses the dissenting opinion in the criminal proceedings and its importance in imposing life imprisonment sentence. The author presents legal provisions governing the conditions for the submission of a dissenting sentence from the perspective of its functions, which are crucial both for the parties to the proceedings and the social impact of judicial decisions. He analyses the standards for administering life imprisonment sentence defined by the European Court of Human Rights, the Supreme Court and the appeals courts. On the example of the decisions of general courts, the author discusses the reasons for life imprisonment sentences, the grounds of judgements in dissenting opinions and their common, converging elements.

- Summary/Abstract:Those sentenced to life imprisonment have two possibilities for leaving prison: conditional early release and pardon. Relatively few respondents sentenced to life imprisonment decided to plea for clemency. Their requests for pardon were made in a fairly uniform manner, indicating remorse, the will to redress the offence and the progress in rehabilitation. The court opinions concerning the pleas for clemency were mostly negative, as according to courts, pardon could be granted when extraordinary and exceptional events occur.

- Summary/Abstract:Conditional early release is one of the most important institutions allowing regulation of the actual length of the sentence. The decision on conditional release can be undertaken when the sentence is being carried out or pronounced, raising the statutory threshold for granting it. The issue arouses strong emotions in relation to the longest prison sentences. Is setting the threshold drastically at 50 years, when the convicted may submit the first application for conditional release, not dehumanization of the sentence itself and its implementation? Is it not a mockery of the rehabilitation in prison? What meaning can be given to his life without the prospect of freeing him from the burden of prison isolation? Is raising the threshold not sentencing the prisoner to slow death within the walls?

- Author(s):Maria Gordon
- Language:Polish

- Keywords:forensic psychological evaluation; sanity; personality; motivation
- Summary/Abstract:The study contains data obtained from the analysis of 43 forensic psychological evaluations of the sentenced to life imprisonment, which were carried out in 2008-2018. The material was gathered during the research conducted by the academic staff of the Department of Criminology and Criminal Policy of the Faculty of Applied Sciences and Resocialization at Warsaw University and the Research Group under the direction of Professor Andrzej Rzepliński. The analysis concerns the compliance of the evaluations with the standards of forensic psychological evaluation of homicide offenders and continues the research on 102 forensic psychological evaluations, whose results were published in 2017 in the book ["Life imprisonment, the perpetrator, his crime and punishment"] "Dożywotnie pozbawienie wolności, zabójca, jego zbrodnia i kara" (red. A. Rzepliński, M. Ejchart-Dubois i M. Niełaczna). The obtained results show positive changes, mainly in the diagnosis of intellectual ability and character structure of the perpetrators. However, psychologists still do not see the need for referring to group influence on the perpetrators who work in groups and, what is crucial, do not diagnose motivational processes of the subjects. Thus, they do not provide the courts with information useful for establishing the responsibility of the perpetrators of violent crimes facing life imprisonment.

(The psychological-forensic diagnosis of life-term prisoners)
- Author(s):Maria Gordon
- Language:Polish
- Subject(s):Criminal Law
- Page Range:333-380
- No. of Pages:48
- Keywords:psychological forensic diagnosis; life-term prisoners; susceptibility to corrective measures
- Summary/Abstract:The text aims to show the value of a properly conducted psychological forensic diagnosis in organizing rehabilitation of the people serving a prison sentence and in particular life-term prisoners. Establishing a psychological forensic diagnosis requires the knowledge of factors contributing to the effectiveness of the process, as well as those inhibiting rehabilitation. The analysis of 50 psychological forensic opinions of life-term prisoners shows that in most cases the information contained in the opinions is not sufficient to prepare individual rehabilitation or therapeutic programmes. The author proposes to modify the structure and the contents of psychological forensic diagnoses, which, in his opinion, will make them more useful in preparing corrective measures.

- Keywords:diagnosis versus diagnostic process; effectiveness and success rate of diagnosis; therapeutic procedure
- Summary/Abstract:Professional psychological measures include diagnosing and recommendations based on them. As J. Paluchowski states, this process requires answering the following questions: What is it? Why is it so? Why will it be so and not otherwise? What should be done to achieve the desired state? However, the analysis of psychological forensic diagnosis, documented with the results of scientific analyses, is not optimistic. The article aims to present the rules of diagnostic procedure compliant with the findings of modern science and their evidence in penitentiary practice. The obtained data and conducted analyses show the need to implement such measures that would result in improving effectiveness and success rate of the undertaken psychological activities.

- No. of Pages:34
- Keywords:indefinite isolation; crisis; stress; de-adaptation behaviour; system support
- Summary/Abstract:The discussed research is an example of scientific activity based on systematic and persistent gathering and analysis of the information contained in prison records. The research identifies sensitive moments in prisoners’ life: from waiting for the prison sentence (pre-trial detention) to passing the sentence and serving it. The research distinguished and identified groups of dangerous conduct, such as: self-destructive behaviour, physical and mental violence, rape. It also specified difficult moments in the life of the imprisoned: disintegration of family ties (separation, death of family members). The isolation period was divided into shorter time intervals called sequences in order to organize and include time as a variable. Other variables were taken into account in different tables and the gathered data compared over time. The finding sand results of the research are material for further analysis and represent a practical value. By capturing variable interdependencies, it is possible to point to risk factors and the area where they occur, which allows including adequate protective measures in time. The conducted research and its results indicate the need for continuing scientific studies on people serving prison sentences.

What is the purpose of their education? By analysing court and prison records, conducting interviews with prison authorities and interpreting the existing law, the author tries to answer these questions. She concludes that other factors than those officially declared by the state authorities determine the rights of life-term prisoners, which is a loss to them, their families and the society.

It is easier and more rational to offer a prisoner concrete support such as rehabilitation programmes or interventions, which can help him overcome his own deficiencies, make up for social shortcomings and relations with people, develop personal talents and competences. The process requires building relations to convince the prisoner that the measures proposed by prison authorities – when he is fully contributing to them (on autopilot) – make sense and have a purpose, which are important to him and will take him closer to responsibility and freedom.

- Summary/Abstract:In this chapter, I present a therapeutic system, which is quite unique in terms of serving a prison sentence. The system, especially in the form of a therapeutic ward for convicts with non-psychotic mental disorders or mentally disabled, is the quintessence of the individualization of social rehabilitation interactions. I present a historical outline with the intention of emphasizing the effort which was put in the idea of individualising the prison sentence. I follow the diagnostic process in which the convicts participate, aimed at indicating the most optimal system of serving a sentence for them, with particular emphasis on the procedures related to the therapeutic system. I outline the formulation of an individual therapeutic program for the sentenced, which is the basis for specialist interventions conducted towards him. In conclusion, I attempt to bring the reader closer to the world that is hard to imagine, the world of life-term prisoners, for whom prison becomes home.

- Keywords:life sentence imprisonment; prison staff; attitudes towards prisoners; training of prison staff
- Summary/Abstract:Life imprisonment for crimes that deserve special condemnation is in line with social needs and the populist narrative of politicians with extreme views. It should be remembered, however, that the execution of this most severe punishment is within the competence of the Prison Service and thus burdens officers who have direct contact with this category of inmates. Its effectiveness - understood here as the development of a plan for the optimal functioning of a convict in isolation (in terms of employment, education, organization of free time, participation in readaptation programs etc.), the implementation of which will favour his internal transformation and create conditions enabling him to apply for conditional release - depends, inter alia, on the attitudes and treatment of life prisoners presented by the officers. Attitudes towards other people are shaped, inter alia, through appropriate education, which is why this study attempts to verify the education of prison staff and the attitudes towards prisoners sentenced to life imprisonment represented by Prison Service officers.
