Archives have competence over companies which are in public hands, which is defined by the Protection of Documents and archives and archival institutions act (PDAAIA) and the regulation on Documents and archives Protection. The mentioned acts state that all archives, created at such companies are public propriety no matter where they are located or who keeps them. Companies with do not correspond to the definitions, stated in the above mentioned acts, create private records, which become archives only with a declaration with a decision of the archives of the Republic of Slovenia.Archives are also competent for archival material created before the still existing companies were privatized. All archives, created in the period before privatization is still public propriety. This is a fact most companies do not recognize, since their owner claim that they have purchased the company with all of its records. Many times archivists have major problems with access as already mentioned above. There are, of course, cases, where companies are ready to transfer their historical records for the safekeeping in an archival institution, but they usually do not have enough time or personnel to prepare archives for acquisition in the suitable manner. Advisory service at creators from the field of economy consists of many preparations; the archivists must be well prepared, well acquainted with the field legislation, which defines the work of a specific economy branch. The archivist must first find the necessary legislation to declare a certain corporate body as the creator of archives. If the definition of creators of archives were clearer, we would avoid many unnecessary confrontations with the managers and jurists.
