Summary/Abstract: The study analyzes the issue of the passive subject of the assault of a public official from the point of view of the criminal law in force and is structured on the analysis of the cumulative conditions that are necessary for the detention of this offense, as they were dealt with in doctrine and jurisprudence. The study aims to analyze the institution in order to facilitate its understanding and deepening, as well as to suggest possible necessary legislative changes.
