Summary/Abstract: Scientific conferences entitled “ Szubert Seminars”, organised at the Faculty of Law and Administration of the University of Lodz, have a long tradition. These meetings have two main goals. The first, is to show the multifaceted achievements of an outstanding and recognized researcher of social policy and labour law – Wacław Szubert. The second, is to pay attention to the universality and timelessness of the observations made by this author. His opinions can be an important hint for all researchers currently dealing with employment issues, counteracting unemployment, social insurance, health care and social economy. The variety of topics covered in this book shows the complexity of the relationship between labour law and social policy. Both areas of science benefit from the fact that their representatives conduct research in close cooperation. Thanks to this, social policy becomes the basis for building the axiological assumptions of labour law institutions. Labour law, in turn, provides tools for verifying the objectives and tasks defined by social policy, as well as the ways of their implementation.

- Summary/Abstract:We live in a world of the increased dynamics of changes caused by new technology, globalization and the demographic revolution. Adapting to change requires indicating the most appropriate direction of reforms, which would favour settlement of social issues. Accordingly, one must decide: on the one hand, how much we should follow the principles of social policy shaped in the industrial era, with its institutional successes, such as social insurance and industrial relations, while protecting the world of work against poverty and moving peacefully from disputes and conflicts; on the other hand, how far should we proceed in altering the classic rules and institutions, while ensuring universal social rights, and leaving work-related commitments only to those who want and can work and do have appropriate skills and qualifications. Between these extreme visions a new model of social policy will be shaped.

- Summary/Abstract:The simultaneous crisis of the recently-influential neoliberalism and the exploitation of left-wing ideas lead to the alarming rise of populism, disregarding the debate in which the arguments reaffirmed by the researchers do matter. The development of knowledge and technological progress open up more and more opportunities to protect health and prolong life, yet at the same time the unsubstantiatedly raised hopes lead to unreasonable expectations, and the absurd pressures resulting from disappointment become dangerous to democratic order. It can be argued that health policy is no exception, that it shares fate with other social policies, where the rational argument has ever weaker persuasive forces. The author is searching for answers to the following questions: on universal access to health care, on the model of the healthcare system, on health determinants, on health inequalities and confront them with the answers possibly given by Professor Szubert.

- Summary/Abstract:The universal protection of the long-term employment relationship guaranteed by the labour law provisions serves the satisfaction of the basic need of people at the age of professional activity. Legal security as a universal axiological basis of modern labour law and social security has been presented to the entourage of lawyers specializing in labour law relatively recently. This raises the need to specify the relationship between social policy and labour law. The direct reason for the interest in these interdependencies constitute the activities of the modern legislator, that applies the structure of the termination of employment relations with the population of workers employed in public/state-owned workplaces, which is contrary to the idea of legal security.

- Summary/Abstract:Social policy is focused on solving social problems. Labor law serves the implementation of social policy. Social policy, and in particular employment policy, plays a significant role in shaping better living and working conditions, protects against exploitation, improves occupational health and safety and is responsible for providing protection in the event of losing a source of income. Access to basic social benefits is obtained through participation in the labor market and in the absence of employment by social assistance institutions. The state is responsible for the implementation of the social policy objectives. By means of legal regulations, the state interferes with the content of the employment relationship in order to create decent living, working and paying conditions. In this study there are indicated some examples of solutions that involve the employer in the process of implementing social policy assumptions in the scope related to satisfying the living, social and cultural needs of employees.

- Summary/Abstract:Legislation regarding a social enterprise in Poland aims to accept its functional meaning. In this context, the non-economic circumstances of the emergence of social enterprises as well as the affirmative and inclusive nature of employment in social enterprises are important. - Summary/Abstract:Social welfare organizational units, as entities with the widest information on the family and professional situation of the unemployed, have been included in the system of state entities helping the unemployed in professional and social activation. Social welfare units can use in this respect both the instruments provided for in the Act on social assistance (eg. social contract, individual program of getting out of homelessness), as well as in other legal acts, forming the basis for the so-called social employment. Experiences of social assistance centers indicate that although the effects of the results measured by the number of unemployed who find employment are not always satisfactory, the legitimacy of social assistance in taking up actions for the unemployed is beyond doubt, particularly since – in the case of social employment – it is not only the way to professional activation of the unemployed, but to shape local employment policy.

- Summary/Abstract:The right to work is a notion that has evolved over the years. In the light of international standards, one of the elements of the right to work is properly organised and generally available job placement services. Such interpretation of the right to work is particularly visible in the light of the European Social Charter. The Act on Employment Promotion and Labour Market Institutions that currently regulates issues related to job placement services does not contain a typical normative definition of this term, but provides a description of how it should be understood. The paper analyses Polish job placement regulations in terms of the degree to which they guarantee the right to work as defined in international standards.

- Summary/Abstract:Tasks of social policy aimed at achieving goals set by it are implemented by various mechanisms that are fulfilled by individual entities functioning in the legal reality. One of such entities are temporary work agencies. This publication presents the scope of temporary employment agencies’ implementation of social policy tasks, with particular emphasis on employment policy. The analysis carried out proves that temporary work agencies implement social policy tasks in many aspects, particularly on the ground of economic development and satisfying the needs of citizens. - Summary/Abstract:With the implementation of Directives 2000/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation, 2000/43/EC of 29 June 2000 concerning equal treatment of persons irrespective of racial origin or ethnic, and Directive 2004/113/EC of 13 December 2004 on equal treatment of men and women in the access to and supply of goods and services in the European Union, a new stage in the redefinition of two concepts began in EU legislation: equality and non-discrimination. The current draft “horizontal” directive aims to broaden the principle of non-discrimination and the principle of equality, which, according to the concept adopted in this article, are identical concepts. In the article, the author answers an important question, why EU legislation, constantly extends the principle of non-discrimination and the principle of equality, while there are no grounds for it.

- Summary/Abstract:The study analyses the issue of occupational burnout in the context of selected regulations of Polish labour law. The author presents the notion of occupational burnout and its causes – in particular those which, from a legal perspective, are of the utmost significance. - Summary/Abstract:Family is a basic element of society structure which makes it a universal value in the whole world of people’s society irrespective of socioeconomic or political systems of any country. Being constantly a great universal value as a basic social group at the same time family is undergoing dynamic transformation courses mainly related to changing social customs. At the same time more and more unfavorable demographic tendencies, such as postponement of decisions concerning birth of the first child and low fertility rate, are observed. Taking in consideration all tendencies mentioned above one should emphasize the need for different kind of state actions bound for diversion or at least stopping the negative demographic phenomena. One of them is properly shaped family policy, which consists of different forms of legal, economic and social support of the State for the families. In the paper there have been presented some labour law instruments, supporting State family policy guidelines implementation. The author has mainly concentrated on those legal regulations, which have been amended in the past few years. These include legal solutions related to working time and work organization, maternity protection and leaves related to parenthood.

- Summary/Abstract:The minimum wage is, by its nature, related to workers and their families. It is the lowest possible monthly pay that a full-time worker can get. At the same time, it curtails the rights and freedoms of employers thus protecting the workers from poverty and social exclusion. An analysis of the social function of the minimum wage in reducing poverty and income inequality shows that it is hardly effective. Elimination of poverty depends more on the lower unemployment rate, which suggests that poverty could be alleviated better by means of e.g. the tax system or social transfers. The minimum wage plays an exceptionally important social role ensuring that workers can satisfy their fundamental everyday needs. The statutory regulation of the minimum wage ensures that the pay for work is not grossly understated and nominal only.

- Summary/Abstract:Employee capital programmes (ECP) are part of The Strategy for Responsible Development for the period up to 2020 (including the perspective up to 2030). This voluntary form of collecting funds for old age, will be an element of the third pillar of the pension system in Poland. The legal nature of this construction is similar to the occupational pension scheme and the open pension fund. The article presents the rights and obligations of the employer creating the program and the participant, who will join the employee capital plan.
