The subject of the following study is to show the institution of conviction without a trial in time perspective and the impact of the regulations of other countries on the current nature of this institution. Similarity of conviction without a trial to Italian pattegiamento has been presented. The original regulation of Art. 335 of the Code of the Criminal Procedure differs significantly from the current wording and subject scope of conviction without a trial. In view of the adopted and planned changes, the attention has been paid to the protection of aggrieved party’s rights which should also be respected in modified proceedings. Changes introduced by means of the amendment of September 2013 and February 2015 have been evaluated. Changes which are currently the subject of a legislative process have been positively evaluated.

Marka jako czynnik determinujący wybory żywieniowe dzieci

The survey’s objective was to evaluate brand’s impact on children’s food choices. The survey was carried out at the turn of March and April 2011. The survey group was comprised of children (n=40) aged 5-6. Children were choosing from among the deliberately chosen product groups. There was also sent a questionnaire to the surveyed children’s parents, which provided the information on family’s eating habits. There were indicated correlations between the children’s positive attitude towards branded products and the number of hours designed to watch TV, frequency of TV watch during meals, frequency of accompanying the parents while shopping and frequency of staying at the fast food type bars. Products of the global brands were chosen more often and evaluated better that products of the local brands. The brand’s impact on children’s nutrition choices were considered as significant and, at the same time, dependent on the family’s eating habits.

The objective of considerations is to present one of the methods of checking the quality of customer service in the selling process and/or service provision – surveys of the Mystery Customer type. The described survey was carried out among dealers of the Ford Polska Sp. z o.o. company in November 2011. There was carried out an analysis of the assumptions adopted for the survey, way of its implementation and use of the survey results for improvement of customer service standards. There was also presented the manner of use of the final results of those surveys as well as some general conclusions related to an impact of the selected issues on improvement of the process of customer service by Ford Polska Sp. z o.o.

Visoki sudski i tužilački savet Turske i usaglašenost sa evropskim standardima

In this paper, in an attempt to develop an overview, the author strives to present international standards on judicial councils and in line with the standards to assess legal framework in Turkey after amendments of the Law on High Judicial Council. Amendments to the Law on High Judicial Council were adopted in 2014. However, Dutch Judges for Judges Association, MEDEL (European association of judges and prosecutors for liberties and democracy, as well as Consultative Council of European Judges raised objections on specific articles and solutions in the Law that violated independence of judiciary and Council and Judicial Council .subordinated to the executive branch. Having that in mind, author referred to the remarks and pointed international standards and models of regulating these issues in line with those standards.

ZKP Srbije iz 2011 –kraj reforme ili samo jedan neuspešan korak procesa reforme ?

The subject of analysis in this paper are three sets of questions. The first is devoted to the analysis of the general characteristics of the process of reform of the criminal procedural legislation Serbian long over ten years. The second issue concerns the professional and critical analysis of each of a series of papers by the new CPC of RS 2011th year, as the last result of the reform of its criminal legislation. The third group is dedicated to the presentation of the author’s reasons for concluding that the CPC of RS 2011th year. represents not, successful, end the reform (as deemed legislator) but only one failed step in the reform process.

In this paper, in an attempt to develop an overview, the author strives to present international standards and models of judicial councils, as well as the Netherlands experience in establishment of Council for the Judiciary, historical development, competences, composition, staffing, budget, continuous assessment of their work and improvement of procedures. Reason for presenting the overview of the Netherlands experience is present activities and discussion on drafting new Judicial Reform Strategy for 2013 – 2018 and need for advancement and improvement of High Judicial Council and State Prosecutorial Council role and position, especially having in mind Council of Europe assessment from September 2010 and challenges in implementation of new reform activities.

Metoda modelowania procesu oceny efektywności produkcji z wykorzystaniem standardu BPMN

At the age of dynamically changing market conditions, the speed of information flow and decision-making is one of the key factors affecting the competitiveness of enterprises. The decision-making process can be effectively assisted by simulation tools that allow multi-criteria analysis of the potential benefits or risks of the planned activities. The stage immediately preceding the use of simulation tools is modelling process, without which there is no way to effectively monitor and control the realized activities. The research problem defined by the authors is the way to carry out an assessment of the production process efficiency, taking into account the multidimensional analysis of the interdependencies within the process as well as the relationships with other processes that affect the continuity of the material flow. The aim of this paper is to present the concept of an evaluation model for the production process efficiency, as a proposal to minimize the identified research gaps in the fragmented definition of efficiency issues. This article focuses on the problem of modelling the evaluation process of production efficiency in iGrafx Process 2011 for Six Sigma, using the BPMN. The choice of this standard was determined by the representativeness of the modelling of processes and operating systems as well as the universal character, which allows the use of applications for other standards and notations. The result of the research conducted by the authors is a model that is conceptually prepared for verification, both in business practice as well as in the simulation procedure.

Ewolucja Zagrożenia Terrorystycznego Na Bliskim Wschodzie W 2016 Roku

For this purpose, firstly, the essence and determinants of the contemporary terrorism threat have been analyzed. Some main Middle East terrorist organizations, actively operating in this area, have also been indicated. Secondly, the chronology and the most important terrorism trends in the region have been presented. And last but not least some predictive scenarios regarding the development of above phenomenon in 2017 and beyond have been pointed out.

Ujemny kapitał własny w przedsiębiorstwie a kontynuacja działalności

The paper analyzes the financial situation of enterprises, which had negative equity in the period 2012–2015 in the context of their continued activity. Profitability and debt ratios and repayment periods indicated a very unfavourable financial situation. According to the legal provisions, these companies should be bankrupt (liquidated) but they still function, unfortunately, increasing the shortage of equity by systematic debt, which puts creditors in a very difficult situation.

This commentary refers to the assessment of the situation in which there are grounds conditioning the reduction of compensation due to an underage, who contributed to the injury, and because of his age is not responsible, and is it possible when required by the principles of community life – to apply by analogy Art. 428 of the Civil Code. The author agrees with the Supreme Court, that in the factual situation of the case it can be applied by analogy with the said provision.

The Importance of Local Events in Enriching the Cultural and Tourism Offer

In the municipality of Ruma twenty five events take place per year. Most of these events have local or regional character. The event "Christmas Street" is the youngest event which is being organized in Ruma, the first time was held in late 2011. The subject of this paper is to study this event that complements the existing tourism offer of Ruma as potential tourist destination of Vojvodina. The aim of this paper is to highlight the importance of this event in the cultural enrichment of Ruma and its surroundings as well as the development of event tourism and positive presentation of the Municipality of Ruma. The significance of local events for enrichment of cultural tourism offer will be presented as Case study of “Christmas street” in the city of Ruma.

Landspout Across Novi Beograd, 24 May 2012 – Synoptic Analysis

In this study we have analysed a case of the landspout across Novi Beograd on 24 May 2012. We have used a synoptic analysis method in the research and the description of the landspout event is based on visual evidence and photographs. According to the available data, it can be concluded that there were favourable conditions for a landspout development since there was a process and an increased amount of instability. The landspout occured within the northeast stream which moved over Belgrade and further toward the southeast and west. Based upon synoptic data analysis, it can’t be said that there was a cold air advection. Surface air was warm enough, but not the air in the upper layers of the atmosphere. The conditions for a landspout development were favourable – high relative air humidity and increased vertical and horizontal air currents.

Planning Theory - A Critical Review of the Dominant Planning Models in 21st Century and Proposed Reconstruction

The entire work is based on the assumption that the root of the planning crisis at the global level is largely found in the inadequate development of planning theory. The purpose of this research is to find a theoretical basis that would allow better theory and practice linking within a more efficient planning system. By applying the method of analysis and synthesis, historical and descriptive method, the development of theoretical thinking about problems and issues in the planning is presented, then the current state of theory in view of the dominant models and their ''critical'' points. In this paper, namely, it is pointed out that because of these points, planning, as a mechanism of state intervention, still does not respond adequately to current and future challenges and demands of society. Accordingly, and with the realization of the basic objectives and applying the method of induction and deduction, planning theory reconstruction has been proposed, which is the main result of the work.

Dynamics of Suspended Sediment Load in the Upper Part of the Rasina River Basin in 2010

The paper treats the issue of the suspended sediment load transport in the upper part of the Rasina River Basin, upstream from the ''Ćelije" reservoir during the year of 2010. Measurements of the suspended sediment concentrations were being done at two hydrological profiles Brus and Ravni. Total quantity of the suspended sediment load that was transported at the profile of Brus in 2010 amounted to 3,437.3 t, which gave the specific transport of 16.4 t/km2 /year. At the downstream profile of Ravni, 43,165 t of the suspended sediment load was transported, that is, 95.7 t/km2 /year. The basin on the whole is characterized by the existence of two seasons, which by their characteristics in the load transport represent the extreme variants. During the winter-spring season, 74-85.8 % of the total annual load was transported, аnd during the summer-autumn season between 14.2 and 26 %.

Пронос хемијски раствореног наноса у хидролошки екстремним условима у сливу Црнице

During 2010, 62065.3 t of the dissolved load were transported from the Crnica Basin, which was 5.1 times higher than the long-term average value. In hydrological terms the studied year was specific. In the period from January to May the amount of runoff water was significantly above the average perennial values, while in the period from August to November the amount was below the perennial average. According to the hydrological conditions in the period January-May 82.3% were transported, and in the period August-November only 5.1% of the annual dissolved load amount. Most of the year (54.2% of the time) the specific runoff was less than 10 l/s/km2, the average water mineralization was 374.9 mg/l, and in that time 13% of the total annual amount of the dissolved load was evacuated. On the other hand, the specific runoffs greater than 50 l/s/km2 represented 13.4% of the annual frequency, the average water mineralization was 263.3 mg/l, but for that time period even 53.9% of the annual quantity of the dissolved load was evacuated. Legislation in the Czech Republic in 2014 – a quantitative overview

Treatment of sewage sludge for fuel cells supply

Sewage sludge represents the main fraction of municipal waste generated in Poland. Since its production increases rapidly, an effective method for its decomposition needs to be found. Due to conventional energy sources depletion, new solutions allowing for renewable energy production are recommended. One of the methods for conversion of sewage sludge into green energy is application of the fuel cells feeding with gaseous residuals of sewage sludge, obtained as a result of different thermal or biological processes. Such a system can be easily modified and adjusted to the individual needs, which makes this solution very promising. The article analyses biological and thermal processes that can be used in converting sewage sludge into a useful input for various types of fuel cells.

Pojęcie ostateczności decyzji administracyjnej w świetle zastosowania wniosku o ponowne rozpatrzenie sprawy

This article concerns the problem associated with the nature of the institution of a petition for reconsideration of the case in view of regulation No 16 of the Administrative Procedure Code in the version before the amendment dated 3 December 2010, which entered into force on 11 April 2011. Despite the amendment, to this day the provision is the source of many disputes, which is reflected in a very non-uniform judicial practice. On the basis of this regulation can be observed, how defective constructed legal provisions affect the administration of justice and the application of the law by creating situations in which the courts take over the functions of law making. On the selected example is shown, how one decision of the Supreme Court, being the basis of decisions of courts of appeal, causes that victims defective administrative decision are charged with the responsibility for legislative errors. Knowledge of the matter, which is the subject of this publication, is extremely important for all practitioners as well as theorists of the law because of the importance of the issues, which accompany the main theme. The work is based on an analysis of the concept of finality and validity of administration decision and depth on theoretical consideration and extensive discussion of the judicial practice of administrative courts, civil courts and Constitutional Tribunal.
