Summary/Abstract: The texts collected in this volume analyse selected reforms in administrative law in Poland adopted in the face of civilisational changes, such as digitalisation, globalisation and energy transition (green transition), as well as public health threats resulting from the COVID-19 pandemic. The publication, prepared by young law practictioners, is divided into three parts. The first part discusses the issue of preventive vaccinations, the protection of monuments and nature, the second part discusses the national public administration, its structures and changes, the third part is dedicated to the access to public information, new technologies and computerisation of administrative and court-administrative proceedings.

- Summary/Abstract:The subject of mandatory vaccinations is a controversial issue. Recently, more and more people are refusing to subject themselves or their children to mandatory vaccinations. The article presents an analysis of the legal nature of the obligation to receive vaccination in the context of the Polish legal system. The author focuses on the provisions of the Law on prevention and control of infections and infectious diseases. Identifying and considering the legal aspects related to the obligation to vaccinate. The author focuses on the legal aspects of the obligation to vaccinate, including the obligation to vaccinate children, and examines the issue of legal liability for failure to vaccinate. The article also includes an analysis of enforcement procedures aimed at implementing the obligation to perform vaccinations. The author compiles and confronts the views of representatives of the doctrine and analyzes the jurisprudence of administrative courts in the context of the issues discussed. The research methods used by the author are mainly based on a dogmatic-legal approach, allowing deep analysis of legal texts, interpretation of regulations and identification of possible normative collisions.

- Summary/Abstract:The use of quarantine by sanitary and epidemiological services and the police reached its peak during the COVID-19 pandemic. Faced with the threat to public health, the legislative authority has rapidly developed additional and modified existing provisions on the quarantine mechanism, including the consequences of failure to comply with the regulations and the manner in which quarantine is performed. This publication aims to examine administrative and criminal sanctions for the infringement of the quarantine obligation, as well as to establish the relations between them. The structure of the commented provisions raises objections from representatives of legal sciences in the field of administrative, criminal and constitutional law.

- Summary/Abstract:The author presents selected rulings and legal solutions in Poland in the field of mandatory vaccinations, considered an important element of the public health safety. Health understood as a public good is protected by public authorities. Decisions taken by the Chief Sanitary Inspectorate, which obliged parents to subject children to mandatory vaccination, were challenged by administrative courts. As a result, the Chief Sanitary Inspectorate began enforcement proceedings without issuing a decision. This action proved illegal as the Inspectorate is not competent to carry out the execution of a non-monetary obligation, which belongs to a voivode, and the Inspection acts only as a creditor. Consequently, those authorities made appropriate administrative arrangements. The publication also addresses the issues of the right to respect private life in connection with the state’s interference in the physical sphere of citizens and penalization of the avoidance of mandatory vaccinations and infringements of sanitary and epidemiological regulations.

- Summary/Abstract:The author presents the broad issue of the vaccination obligation, especially the methods of its administrative enforcement, and the legal acts on which this obligation is based, especially the legal nature of the Vaccination Program. The aim of the publication is to draw attention to the problem of the existence of legislative acts of public administration, perceived in the doctrine of administrative law, which often specify the legal obligations implemented by universally binding law, such as the vaccination obligation. - Summary/Abstract:The publication concerns the issue of the legal position of a minister, which is regulated primarily by the provisions of the Constitution of the Republic of Poland of 1997 and by statutes. The analysis shows the evolution of this legal position, which took place due to the existence of many fundamental laws in Poland, shaping the competences of ministers in a different way. In this respect, particular attention has been paid to selected provisions of the Constitution of the People’s Republic of Poland of 1952, as well as the Small Constitution of 1992, thus acts that directly preceded the binding Constitution of the Republic of Poland and had some impact on the shape of the current systemic solutions. The discussion of the scope of competences and duties of ministers was carried out within the framework of three spheres of the legal position of a minister, which can be distinguished on the grounds of the provisions of the currently binding constitution. These spheres are: the function of a member of the Council of Ministers, the function of a minister heading a department of government administration, and the function of a minister performing tasks assigned by the Prime Minister.

- Summary/Abstract:The article is an attempt to diagnose the problems related to the looted works of art and their restitution. The paper tries to examine the relations between different public administration bodies, which are responsible for the recovery of the Polish heritage. The main focus is put on the Ministry of Culture and National Heritage and legal frameworks it uses to succeed. Further and deepened study of the biggest and most important venture of the authorities – the electronic Database of Wartime Losses – allows for a better understanding of historical and systematic problems the state faces when trying to reclaim what once belonged to the Poles or was part of public collections. A comparison with other countries’ attempts to restore their cultural heritage gives a perspective of what else can be done. The lack of coordination and cooperation both between the governmental departments and public institutions with privately-owned enterprises calls for the administration’s immediate and substantive actions.

- Summary/Abstract:The transcription of a certificate of same-sex marriage contracted abroad, even though it is not a new problem, still generates considerable controversy. Administrative courts, adopting views of the overwhelming majority of doctrine, consider transcription of such an act as inadmissible, giving as a reason its contradiction with fundamental principles of the Polish legal order. Therefore, within the framework of this article, an analysis of Article 18 of the Polish Constitution is presented, with particular emphasis on the positions of those representatives of science who do not see this article as an obstacle to institutionalizing same-sex partnerships. The institution of transcription itself, the public order clause and question of evidentiary force of foreign official documents were also characterized. A proper place was also devoted to the jurisprudence of administrative courts, presenting established line of judicature and a „precedent” judgment breaking out of it. Attention was also paid to the highly relevant European Court of Human Rights’ case law, implementation of which could make the problem addressed in this study, at least partially, outdated.

- Summary/Abstract:Pursuant to the Access to Public Information Act of September 6, 2001, denying access to public information is possible, among other cases, if the information covered by the request constitutes classified information. Although undoubtedly some information, for reasons of state security and other legitimate interests, should be subject to a certain degree of protection, this may lead to a reduction in the society’s ability to control the – often controversial and emotionally charged in the public debate – activities of the secret services. The doctrine and non-governmental organizations attempt to answer the question of how to simultaneously ensure the safety of legally protected interests and an adequate level of transparency in the activities of secret services. This paper reviews the examples of answers to this question in relation to balancing these values in the framework of access to public information and against the background of the current state of the law and positions appearing in the case law of the Supreme Administrative Court.

- Summary/Abstract:The purpose of the article is to present the role of local government units in the context of health-oriented attitudes of their residents on the example of alcohol policy. Alcohol consumption by Poles continues to rise and remains above the European average. The amendment to the Act on Upbringing in Sobriety and Counteracting Alcoholism in 2018 introduced a number of additional powers for local governments that enable effective shaping of local alcohol policy. The largest beneficiaries are councils, which may impose restrictions on access to alcohol. The novelty will now be available to local governments through the reports of the Staszic Institute from 2019 and the report of the Supreme Audit Office. These documents show difficulties that actually hinder the effective implementation of municipal prevention programs.

- Summary/Abstract:If there are any universal values that unite nations regardless of the latitude, then one of them is the protection of their monuments and national heritage. Hence, it should come as no surprise that legal regulations concerning these areas have appeared not only in Poland, but also in other parts of the world. One of the regions with institutional concepts similar to the Polish ones is South Korea. Korean system, although similar in several respects, is often assessed more positively than the Polish one. The aim of this article is to describe the similarities and differences between the Polish and the South Korean systems of monument protection and to indicate the solutions adopted in the Republic of Korea, which could potentially constitute a model to improve the domestic regulations in this area.

- Summary/Abstract:The publication aims to analyse the role of public administration as guarantor of protection of individual rights and freedoms in relations with global corporations. In the era of digitalization of social life, a significant part of the functioning of individuals has moved to the online world, in respect of which the state still has the duty to care for individual rights, such as freedom of speech. Nevertheless, companies providing online services have a real advantage over the administration, which is connected to the global nature of their services and often comparable to the personal and property resources of the administration. In this state of affairs, the effectiveness of the existing perception of the administration as the supervisor of digital entities should be questioned. In the author’s view, the effectiveness of public administration in the world of hegemony of global corporations requires partial globalization of both the administration and the administrative law, as well as the use of a wider range of legal forms of action, in particular, of a consensual nature.

- Summary/Abstract:Augmented Reality it is a technology which allows to put computer-generated items on real objects. The view received is “augmented” by new components, displayed on device screen or directly on particular object, depending on concrete equipment. Potential for AR application extends significantly beyond entertainment sector, and may as well revolutionize people’s everyday life. First cases of augmented reality implementation revealed a wide range of new legal problems, which are attached to it. Some of them embrace potential breaches of public interest, including public security and spatial order. A possibility of using the administrative law as a remedy for those problems is debatable at the present stage of technological development. Apart from that, establishing new legal standards may be already suggested to a limited extent.

- Summary/Abstract:The article analyses the legality of the use of unmanned aerial vehicle by public administration bodies in order to monitor air quality and control pollution resulting from the incineration of substances that are hazardous to the environment and human health. In recent years, due to the intense increase in the level of air pollution, the issue of environmental devastation in Poland is particularly important. In Polish law the so-called „anti-smog resolutions” apply at local levels – they are local law acts restricting the use of specific fuels or installations. In addition, effective control instruments should be in place to provide an appropriate air quality protection as part of public administration activities, ensuring compliance with local laws and preventing air pollution. Furthermore, the subject of analysis of the article is to bring the issues related to modern methods of equipment for drones, manner of sampling and testing the chemical compositions of polluted air and to provide examples of the use of unmanned aerial vehicles.

- Summary/Abstract:Inventing new personal conveyors (such as e-scooters, electric unicycles, hoverboards) was noticed relatively late by the Polish legislature. What is even more intriguing, is the fact that drafting the provisions regarding personal transportation devices (PTD) took almost five years. That time was also the period in which the status of PTD and their users liability was uncertain. The article presents the whole legislative procedure concerning personal transportation devices and tries to make conclusions regarding that matter.
