The study highlights the methods of intimidation used by the Russian authorities against journalists in order to force them to adhere to and promote the official political discourse.

This contribution highlights the challenges of the protection of artistic freedom by the European Court of Human Rights in Eastern European countries. Diminished by a lack of clear definition, artistic freedom is the target of explicit and implicit attacks by public authorities, elements that make the work of the Court more complex. The study of European case law also shows that the protection of artistic freedom implies the guarantee of a balance between the preservation of democratic requirements and the protection of morality. This balance is difficult to grasp due to the subjective nature of art.

The article also explores the challenges of international criminal justice, as well as possible ways of reinforcing the mechanisms of international law.

This research focuses on the question of installing video surveillance systems in Romanian pre-university educational institutions, which aims to ensure the safety and protection of people, property and values. This measure seems to be mostly accepted by parents’ federations, but largely rejected by professional union federations due to the lack of written consent from teachers and parents. However, it also raises questions of compliance with the Constitution, both from an extrinsic and intrinsic point of view, which are analyzed by the author.

Examining the Continuation of Suicide Prevention in Probation System: Empirical Evidence from Europe

The policies of the vast majority of nations and jurisdictions prioritize the prevention of suicide. In an effort to comprehend and eventually prevent suicide, psychologists, social scientists and forensic specialists from a variety of disciplines have provided suicide theories to explain the characteristics that render certain individuals more susceptible to suicidal behavior than most others. This review of the international practices for the continuation of suicide prevention in probation considers risk factors for suicide in probation, how probation can provide initiatives for prevention strategies, and what is currently identified as strategies to lower suicide among persons who are on probation supervision, generating the best practices and evidence. The aim of this review is to explore how to provide suicide prevention program (SPP) to probationers and what are best international practices that ensure the continuation of the suicide prevention program after early conditional release of a prisoner. The author examines implications of findings resulted from these studies and makes suggestions for possible best practices. The programs designed to improve the mental health of at-risk offenders need to be reliable and thoroughly evaluated for effectiveness in probation. Additional services for mentally disturbed offenders need to be arranged after their release from prison in order to be reintegrated into the community. Practical implications are examined.

La création de l’État géorgien remonte au IIIe siècle avant Jésus-Christ. À partir du XVIIIe siècle, la Russie tsariste assume le rôle de puissance « protectrice » et, en 1801, annexe la Géorgie. Après la Première Guerre mondiale, l’État démocratique de Géorgie connaît trois ans d’indépendance (1921-1924) avant d’être conquise par « l’armée rouge » et incorporée, d’abord dans la République soviétique socialiste fédérale de Transcaucasie et, ensuite, dans l’Union soviétique. Lorsque l’Union soviétique commence à se désintégrer, la Géorgie engage son chemin vers l’indépendance. L’analyse des rapports de l’Assemblée parlementaire du Conseil de l’Europe5 permet de conclure qu’à partir de 2003, la Géorgie a pratiquement commencé l’exécution des obligations prises lors de son adhésion au Conseil de l’Europe en 1999.

L’ÉTAT DE DROIT DANS LES PECO, ENTRE DÉFAILLANCES INTERNES ET CONTRAINTES EUROPÉENNES

Dès son apparition, d’abord, dans le langage des juristes, tels que Kelsen, Duguit , Hauriou , Jellinek ou Carré de Malberg , comme objet « d’un discours savant, accessible aux seuls familiers des arcanes de la pensée juridique » , le concept d’« État de droit », interprété de manière non homogène, a dépassé le champ juridique pour s’imposer dans le discours politique et même devenir un véritable « standard international » contraignant pour les États. Aujourd’hui, partie incontournable du droit positif, le concept d’État de droit est devenu un principe inhérent au régime démocratique, voire son synonyme, puisque porteur de la protection des droits et des libertés fondamentales contre les abus des gouvernants, par des voies de recours juridictionnelles accessibles aux individus.

Pendant longtemps, la subvention accordée par l’État a constitué l’une des principales sources de financement des partis politiques. En vertu de l’article 25 de la loi relative aux partis politiques, seuls les partis politiques ayant recueilli au moins 1 % ou les coalitions ayant recueilli au moins 4 % des suffrages exprimés dans le pays et à l’étranger lors des dernières élections parlementaires peuvent en bénéficier. Le montant annuel de la subvention publique de chaque parti politique ou coalition est déterminé en multipliant le nombre de votes obtenus par le parti ou la coalition par le montant de la subvention publique pour un vote effectif reçu. Ce montant est déterminé chaque année par la loi de finances de la République de Bulgarie. La subvention annuelle d’État est versée aux partis bénéficiaires en quatre fois (article 26 de la loi relative aux partis politiques).

AVORTEMENT EN POLOGNE, ÉTERNEL PROBLÈME SOCIAL, POLITIQUE ET JURIDIQUE

Le problème de l’avortement suscite de grands émois en Pologne depuis des années. Le différend oppose les partisans du renforcement et ceux de l’assouplissement de la loi relative à l’interruption volontaire de grossesse. Il a été relancé à l’occasion des propositions d’amendements législatifs et des décisions du Tribunal constitutionnel, plus particulièrement celle du 22 octobre 20201 qui a fait en sorte que le débat – bien qu’entravé pendant la pandémie et les circonstances extraordinaires qui en résultent – soit toujours présent dans les rues des villes polonaises.

LA PREMIÈRE PRÉSIDENTE DE MOLDAVIE : UN DÉBUT DE MANDAT SEMÉ D’EMBÛCHES

«Vous avez le pouvoir de punir ceux qui vous ont volés, qui vous ont réduits à la misère et contraints de quitter votre maison». C’est par cette phrase que la candidate à la fonction de président de la République de Moldova, Maia Sandu, chef du Parti « Action et solidarité », a souvent commencé ses meetings au cours de la campagne électorale de 2020. Ces déclarations ne relèvent pas de la simple instrumentalisation électoraliste. En 2014, un milliard de dollars, somme équivalente à 15 % du PIB du pays, a disparu des caisses de trois banques nationales. Dans le rapport rédigé par la compagnie américaine Kroll, choisie par les autorités moldaves pour enquêter sur « le vol du siècle », les experts sont parvenus à la conclusion que la somme totale s’élèverait en réalité à trois milliards de dollars. Le schéma criminel a été mis en place avec la complicité d’hommes politiques influents, dont l’oligarque Vlad Plakhotniouk qui a dominé la scène politique moldave pendant de nombreuses années, en soutenant les coalitions « proeuropéennes », et l’ancien Premier ministre Vlad Filat.

LA PRISE EN COMPTE DE LA JURISPRUDENCE DE LA COUR EUROPÉENNE DES DROITS DE L’HOMME PAR LA COUR CONSTITUTIONNELLE DE LA FÉDÉRATION DE RUSSIE

En juillet 1989, Mikhaïl Gorbatchev, Secrétaire général du Comité central du Parti communiste de l’Union soviétique, déclarait devant l’Assemblée parlementaire du Conseil de l’Europe que «la maison européenne commune est une communauté de droit». Son discours historique reflétait la volonté commune des États européens d’affermir la paix et la stabilité. La disparition de l’Union des républiques socialistes soviétiques (ci-après URSS) en 1991 a marqué la fin de la division de l’Europe, offrant enfin une chance aux États de ce continent de s’unir dans le but de créer «un vaste espace de sécurité démocratique». La communauté européenne a réellement pris corps par l’adhésion des nouveaux États indépendants au système de la Convention de sauvegarde des droits de l’homme et des libertés fondamentales adoptée le 4 novembre 1950 à Rome (ciaprès Convention). En rejoignant le Conseil de l’Europe, les États contractants ont non seulement reconnu le principe de la prééminence du droit, mais ils ont surtout offert à leurs citoyens une protection effective de leurs droits fondamentaux, participant de ce fait à l’indivisibilité et à l’universalité des droits de l’homme.

“Ordinary Women” or Female Perpetrators? The German Female Employees in the German Courts of the General Government (1939–1944)

This article provides an initial overview of the German female staff who were employed in German courts across the General Government during the Nazi occupation of Poland, through the prism of twenty-four women and their personal files. At the onset of the occupation, the occupiers quickly established a dense network of legal institutions with the purpose, as this article argues, to establish a sense of “law and order” and normalcy within all spheres of society. With a focus on the Special Courts and German Courts across all five respective districts, this article traces the demographic, personal, and professional background of these German women. It inquires why they were transferred to the General Government and eventually returned to the Reich as late as in the summer of 1944, when the German legal institutions were evacuated. In a further step, their careers and lives throughout the occupation are outlined, through which networks among the German administrative staff become visible. This prism is especially insightful since the German legal sphere in the General Government was a male-dominated work field. However, these women played a decisive role in maintaining and operating the German prosecution of defendants of all ethnic backgrounds. In this way, this article explores the extent to which the female staff can be considered as perpetrators similar to their male counterparts, or what Hannah Arendt coined as “desk murderers”.

Popravený odbojář Petr Křivka získal zpátky svou hodnost

Petr Křivka, a courageous soldier and resistance fighter, was posthumously reinstated to his original rank of infantry sergeant by the Czech Ministry of Defense in 2024, correcting a historical injustice. Křivka, who served in the Czechoslovak foreign army in France and Great Britain, was executed in 1951 after being stripped of his rank due to political persecution. His daring escape from Gestapo captivity in 1940 and subsequent journey through Europe to join the Czechoslovak army in Britain exemplify his bravery. Despite his family's suffering under Nazi and later communist regimes, Křivka continued to fight for his country's freedom. His rehabilitation began in 1990, culminating in the restoration of his military rank and the reinstallation of his grave marker in 2025. This act of recognition honors his legacy and the sacrifices he made for his nation.
